| @ Andy It is not a question of interpretation, it is a question of fact. The road at the school / apartments was built under the Act which says the WPCC has the right to build roads which they consider proper. As we now know the trustees chose to deliberately ignore the law, and then got Lee to lie about their failure to levy payers and the Charity Commission. Whyte and Lee then colluded with lawyers to cover up their failure by obtaining a gerrymandered ‘valuation’ from Daniel Watney. The SBG is not a road, it is clearly a material breach of the law which protects the commons. The Conservators in granting an agreement to alienate the land are ignoring the Act simply to make a few bob. This is misconduct by the trustees, a breach of their legal duty. A ‘change of use’ planning consent to change common, which is protected and designated, into a commercial beer garden for the next five years is unlawful. |
