I guess the rest of your post comes down to WPCC believing that the benches do not contravene the Act and you believing otherwise. I have no legal training or experience and therefore have no idea either way. The WPCC have granted use of common for benches on common land for use by anyone including patrons of the nearby pub. There is no exclusivity (and if there was I would object). I take it WPCC have the right to place benches on the common (there are plenty of benches around the commons). Do the WPCC need planning permission to place a bench on the common? If there was no payment involved (i.e. no commercial venture entered into between the Spencer and the WPCC), would the WPCC have the right to place the benches there themselves? If so, does this all come down to the financial arrangement between the pub and the WPCC? |
