| People who don't like the benches make it sound illegal by using terms such as 'beer garden' and 'exclusive use', both of which are inappropriate. There's no 'inclosure' going on, the benches are for everyone, no-one's appropriating the space and there's no leasing, selling or granting - or at least I hope there's nothing of that nature in the agreement with The Spencer. The only debatable point is that the benches reduce the amount of open space, which they do, for some of the year but there are benches elswehere on the commons that do the same. And to be clear, if the benches were for the exclusive use of The Spencer then I and most others would agree they'd be illegal and to be opposed. |
