| The agreement to place benches on the common is an agreement between the Spencer and the WPCC, which in return for money (rent) the Spencer increases it's 'retail area' and provides tables and chairs for it's customers. By doing so the Spencer increases it's revenues and profits, disproportionately. The agreement is exclusive to the Spencer. The agreement is alienation, as it gives the Spencer the exclusive right The agreement is commercial. So the exclusive agreement, for money, to earn profit = commercial alienation of the common. Unlawful Another example is the lease of the Royal Wimbledon Golf Club's car park which is exclusive, private, enclosed, landscaped and alienation. |
