| @ Craig You say that the majority of the levy payers are supportive of the benches, however there is no evidence to support this. The WPCC conducted a one sided and improvised consultation which was designed to achieve the outcome it did. The ‘consulation’ did not extend to all levy payers, it was limited to a few streets near the Spencer and the customers, many of whom are not levy payers. The survey of course did not point out that the WPCC trustees are breaking the law by allowing the benches. Would residents support the trustees breaking the law? Of course not. Is there any need to change the Act? It is a well drafted piece of legislation that was designed to protect the commons. It only ‘fails’ when the trustees who are elected to ensure it is enforced choose to ignore it, as they are now in both cases of the LFF and SBG. The CEO also chooses to ignore it, by promoting his agenda of ‘lets commercialise the commons’. Having set out to deceive levy payers and the Charity Commission, is Lee really the right person to manage the commons? Despite what you say the 1871 Act does NOT specify that the land is to be used for “the promotion of exercise”. The word promotion does not appear once in the Act. |
