| 34: Open, uninclosed, and unbuilt on... The benches don't "inclose" it 35: Not to sell, lease, grant, or in any manner dispose of any part of the commons... Maybe technically they are not leasing or granting the land. Maybe they are collecting a charitable donation in exchange for some mutually beneficial seating which can be used by any member of the public. 36: Preserve the natural aspect... This is no different to people sitting on the grass near the pub or bringing their own deck chairs. To fully enforce that clause we'd have to ban people from walking, running, sitting, pulling daisies etc on the Common altogether, which of course is ridiculous. I'm no legal expert and genuinely interested to hear from anyone who is. |
