I'm afraid the High Court judges agreed that there was no right of way. So you're back to square one, do not pass go, do not collect the money. Roads can only be built on the Common when the Conservators consider that they are "right and proper" in the context the Act provides. Which is why the present lot, and in particular David Devons, Andrew Simon and John Horrocks who comprised the Putney Hospital Committee should resign, as they played fast and loose with the protections the Act enshrines. They got away with it this time. Hopefully never again. Nick |
