The body that regulates the WPCC is in fact the Charity Commission. Because of their complete disregard for the 1871 Act in signing the confidential easement agreement with Wandsworth Borough Council I thought it was appropriate to make a serious complaint. This was done at the beginning of September. I have been in correspondence with the CC a number of times since since then to provide background information, keeping them up to date with the various initiatives to stop the building on the Common. A short while ago I received a letter from the Commission outlining the complaint and explaining that they did not have the power to adjudicate on what was a complicated legal matter. They did, however, say that they would be writing a letter to the Conservators pointing out their duties as Trustees. A copy of the relevant paragraph is pasted below: "That said, it would be of concern to the Commission if the charity trustees were found to be acting unlawfully and they had not taken adequate steps to ensure that they had power to grant the easement. In light of this, we have written to the Charity to raise the issue with them and remind them of their duties in exercising their decision making discretion, including the duty to satisfy themselves that they are acting within the scope of their powers and the duty to act in the best interests of the charity." It seems that the WPCC had not replied last week, but I have asked the Charity Commission to let me know when they do . . . Nick |
