Proceedings will be civil, (unfortunately), but the Conservators may find themselves personally liable if they continue to ignore their responsibilities as charity trustees. However they will be insured, so that's ok. But the insurance won't pay out if they have acted recklessly. And of course by not getting any specific advice before entering into the easement, that could be reckless... Two legal opinions say the WPCC are acting unlawfully. Will the Conservators face up to their legal duties under the 1871 Act and protect the common from Wandsworth's road? |
