With 160 postings on the 4th thread, I think it makes sense to start a new one - particularly in the light of today's events. I have just noticed on the Friends of Putney Common site that a second legal opinion has been obtained from leading counsel, this time from Philip Petchey, and it reinforces the first - ie that the Commons Conservators acted illegally in granting and selling an easement to WBC. As this is in contravention of an Act of Parliament, does anyone know if this will mean criminal proceedings against the conservators if WBC go ahead with road building, or civil? Obviously the least costly and embarrassing course of action will be for the conservators not to test the courts by executing the deed of easement, and as both a commons and council tax payer this gets my vote. |
