| Yes, you are right. A judge ruled that the Afghan criminal had to serve his sentence in France, though his legal team had argued that deportation would amount to torture under Article 3. However the case of the Albanian criminal has been going on for a year and has still not been resolved. A tribunal judge ruled that his deportation would contravene Article 8 since his child didn’t like foreign chicken nuggets. A senior judge then overturned this ruling but the case is still under review. This case demonstrates at the very least that regardless of whether European judges actually get involved, their interpretation of the Convention influences the British judiciary. |
