Yes Michael where there are shops and commercial properties it makes it nigh on impossible to enfranchise but these are the exceptions. The LVT is a relatively cheap way of challenging a service charge and the very rare occasions I have seen them award costs is in cases where the challenge is frivolous or vexatious. Generally, costs were not awarded in my experience and when it was possible the Council did not push for costs ( even though there were occasions when we should have). My experience is of course based on the public sector and Wandsworth in particular I am aware the private sector is a whole different kettle of fish. One final word when I did my law exams some 50 years ago there was such a thing as caveat emptor (let the buyer beware). One does wonder if the buyers solicitors are doing due diligence on service charges and major works charges. |
