Jonty - you're a bit confused aren't you? That's their intention. Sounds convincing on first glance, doesn't it? Until one looks more closely. Mind you, you've been an apologist for their actions all along, so that's not a surprise. The requirement in law is to obtain a QSR. They didn't. The "client care" letter between WPCC and Drivers Jonas in 2008 set out that the Chartered Surveyor would 1) Provide a QSR if required, and 2) Would act as WPCC's representative in negotiations for the sale of the access. Gregsons later wrote to DJ to confirm that they did not wish them to provide a QSR. There was no valuation advice related to the £250,000 from WPCT, and £350,000 from WBC. Those were the final amounts offered by those organisations after negotiation. Bear in mind the 2008 email from Drivers Jonas that they believed the access was worth £775,000 (referring to the Stokes versus Cambridge principle). 50% of the marriage value. There was no advice from Gregsons as to why the charity could ignore the Charities Act 2011 or earlier legislation. There was a lot of advice on the wording off the easement agreement. Lots of advice on swapping land. Lots of advice on the minutiae of the planned transactions. Indeed, they were involved in agreeing the final wording of the easement signed and completed in August 2014 which confirmed that the charity had complied with Sections 117-121 of the CA2011. If Simon Lee is to be believed, they also wrote the letter to the Charity Commission sent in January 2015 also confirming the same. Why did they do that? Why indeed? Don't get confused between general correspondence related to the negotiation for the sale of the access, and any formal valuation advice, because there wasn't any. How many more times do I have to tell you this is the case? What the Charity Commission understands is based entirely on what they have been told by the WPCC. They have not viewed the 7 lever arch files of documents. As far as I know among the 8 Trustees only myself, John and Shirley have done so, Have any other trustees bothered? You might ask them this evening. If I remember correctly BWB and the Charity Commission and WPCC all admit that the necessary compliance with the CA 2011 QSR was not followed. They broke the law. If the charity has legal advice that it was not necessary to comply then I have not seen it. Why don't you ask Prue Whyte nicely?
