Caroline, BWB were asked in May to draw up draft instructions for a QSR to be commissioned for the sale of access rights in February 2012. Also to suggest three companies to do the work.

Unfortunately the draft instructions contained many material errors of fact, and therefore John, myself and Shirley asked to discuss them. We were refused. No discussion, no consideration. They also suggested three firms that have no knowledge of the local property market, a requirement of the regulations related to the commissioning of a QSR. We suggested alternatives and were ignored. No discussion, no replies to points raised, nothing.

Not, I would suggest, the way to run a charity. BWB then said that we needed TWO QSR's one for 2008, and another for 2010. Meanwhile they began finding ways to claim I was "conflicted". As you know I received a 30pp analysis of my correspondence.

Meanwhile we asked the Chair and Executive for sight of the instructions to BWB. Ignored, then refused. We wrote to BWB for the same, on the basis we were Trustees. Refused. The basis for this non- transparency was that they could only deal with Simon Lee or Keith Luck.

It was their intention to manipulate the findings of a QSR which would delay the whole process of finding out how much the access should have been sold for, and run up the legal bill.

The Audit and Risk Committee therefore put an Agenda item for its meeting in July. When we got to it two of the members walked out quoting "public law issues". The Chief Executive and his staff did the same. By the way these so-called "public law" issues were never explained, and never have been to this day.

So the remaining members of the Committee decided to go ahead and get a QSR. And I'm very glad they did. The Board had previously accepted that the cost of just one QSR would be around £20,000+. And so it turned out.
