As a Conservator, I would of course wish to attend tonight's meeting, unfortunately I am unable to. I have this afternoon received an email with various questions "replied to" by the Trustees. I have of course seen various versions of the replies over the past few days, and I have asked repeatedly for further information in respect of one in particular, (the q's are from Jonty...) The question is #3 ____________ Q3. Compliance With The Charities Act 2011. Did WPCC or any of its then Conservators have any advice on this issue immediately prior to this sale and if so, what was this advice? Response:  Throughout negotiations, initially with the WPCT and subsequently with Wandsworth Borough Council, the Trustees received advice from retained solicitors (including Leading Counsel in the Judicial Review and Appeal Court hearing) and from a senior valuation partner within a nationally established firm of property advisors _______________ The reply by the charity is a nonsense and completely avoids the question; appearing to infer that the "advice received", was on the issue of the CA 2011.  There is no such advice, it does not exist. On the contrary there is legal advice that Gregsons view was that Stokes V Cambridge "set the bar" and that Driver Jonas view on value ie to the charity, for the apartment access (and only the apartment access) was £775,000 (in 2008) The reference to the Leading Counsel has nothing to do with anything, it is a separate and now closed point over the 1871 Act.
