Sue, I remember a discussion about this before the referendum and it could be considered to be advisory. That's because the Referendum Act didn't place any legal obligation for the result to be implemented if the vote was to leave. That's different to referendums in, say, Switzerland, where there is a specific legal obligation to implement the result. I'm not sure why it wasn't but I could guess it's because in the UK it's Parliament that makes the laws, so they have the last say. I suppose that's also why the nature of Brexit wasn't defined? That why say Brexit means Brexit was nonsense; it's a bit like saying pi=pi without defining how it's value is derived :-) |
