| Good point! I have a little experience of dealing with the Information Commissioner in my work (though more in the context of Freedom of Information than data protection). The law is complicated and rather reliant on the growing body of Commissioner's and Tribunal determinations (and a certain amount of caselaw when things have gone all the way to the High Court). Sometime the view of the Commissioner is required to give certainty. If, however, the Met are *not* going to the Commissioner for clarification and/or are not able to cite the precedent/case that has given them cause for concern, then they should be pressed on why not. |
