Or that you'd be risking it if you didn't have third party liability insurance and cover for legal fees (many people do via their bank accounts or home insurance, I'm covered by both of those and by being a member of the Cyclists Touring Club or whatever it is they are called now).

For those that say that cyclists should have mandatory insurance the logical extension of this case would be that cyclists with the requisite cover could then sue any pedestrian that walks out in front of them and causes an accident (even if it is 50:50 like this case). If the pedestrian didn't counter-claim (and didn't have cover) they could end up being liable just like the cyclist was in this case. Would the solution for this to be mandatory pedestrian insurance?
