There are some parallels to the Charlie Alliston case. The implication is that the cyclist had time to sound his airhorn and swerve but, most importantly, did not seem to slow down. By choosing not to slow down they are seen as aggravating the situation. If something like this happens then rule one is to apply to brakes to shed speed, an impact may be unavoidable but the lower the speed then generally the less bad the injuries sustained to any party. The cyclist in question was also knocked unconscious but it seems they did not put in a counter claim for injuries and the time limit for doing so has passed (since this all occurred 3 years ago but has only recently gone to court). If they had put in a claim we'd have probably seen compensation being cancelled out (since the judge ruled it 50:50) and the only winners being the lawyers whose bills would be covered by third party insurance policies (which many people have through their home insurance or bank accounts). It does seem a bit of a slow news day. I know of two cyclists who have recently received compensation after being knocked off their bikes by pedestrians walking into the road without looking. Neither story made the national newspapers. (If only motorists were held to the same standards and same level of scrutiny. The papers [and prisons] would be full of them.) |
