Difficult to say without knowing full details of the sequence of events. If the cyclist started braking at the same time as he started swerving then fine but if he only used the brakes after realising he was swerving in the same direction as the pedestrian had deviated then that was probably too late? Also, can't tell from the article, the judge might have considered he was riding too fast for the conditions, as a car driver I know if, for example, there are children playing, its wise to slow down so I can stop if one darts into the road. It's not true jamming on the brakes is always an option for car drivers - usually works if you have ABS but otherwise you might be wise to use cadence/avoidance braking to avoid skidding into someone? Anyway, I assume the judge had access to a detailed report that we haven't seen? |
