Yes: planning applications have nothing to do with land ownership. A planning application simply determines whether the planning authority will allow you to proceed with the development you seek: it does not speak to your ability to implement that permission. You can submit a planning application for any piece of land (or river - within the borough boundary) you want - you just could not implement or enforce that application unless you own - or have owner's consent for - the area you are seeking planning permission for. So I could apply for planning permission to demolish Buckingham Palace but unless the Queen is minded to sell it to me on the cheap, I couldn't do anything with that permission even if Westminster Council were minded to approve it...which I'm guessing they wouldn't. |
