Michael - the CEO is acting returning officer because the actual returning officer is the Mayor and therefore a elected member of the council with a political affiliation which is only laid aside for the year in which they serve as Mayor. This is for want of a better expression a ceremonial duty of the Mayor and the officers do the actual work.
