…This legislation is part of a wider European human rights initiative that transcends national parliaments and individual political parties - with the British iteration working under a deadline of June 2013.

Last year while chairing the Committee of Ministers of the Council of Europe, the British government took the lead on Council of Europe Recommendation CM/Rec(2010)5.

This Recommendation focused on six areas of human rights, one of which was "combating discrimination on the grounds of sexual orientation and gender identity".

In effect, last night’s vote fell under the aegis of the Council of Europe’s ‘Right to respect for private and family life’, itself a riff on Article 8 of the European Convention on Human Rights.

As the custodian of the Council of Europe’s Recommendation CM/Rec(2010)5, the British government has a deadline of June 2013 to implement the Recommendation.

The Recommendation was articulated in a British government report in March 2011 called "Working for Lesbian, Gay, Bisexual and Transgender Equality: Moving Forward", which pledged to:

“Work towards the full implementation in the UK and across Europe of the Council of Europe's recommendations 'Measures to combat discrimination on grounds of sexual orientation or gender identity' including by using our Chairmanship of the Council of Europe from November 2011 to review progress.”

As chair of the Committee of Ministers of the Council of Europe, the British government then hosted a conference on this area last March and things moved from there.

As such, given "Lesbian, Gay, Bisexual and Transgender Equality" are part of a broader European human rights policy initiative. Due to the UK chairing the Committee of Ministers of the Council of Europe, the British government had to be seen to take the lead on this.

It’s therefore likely a Miliband government would’ve invested similar effort and time into this area as the Cameron one did. Likewise national governments across Europe.
