The filing of WPCC's objection under General Comment is just one small point to illustrate planning officers' obvious bias to developers.  Another I would like everyone reading this forum to take note of is the more serious bias shown to a local serial developer in overlooking the assessment of potential contamination at his development site; not once, not twice but three times.

It is worth nothing that this local family of serial developers are well known to Wandsworth Council because together they partnered the development of a large block of flats in the 1960s which today blights the heart of West Hill Road Conservation Area. 

Over a decade the same developer applied to Wandsworth Council thee times to demolish his former filling station and repair/service workshop and turn the land into a greedy 6 storey block of 26 residential flats.  Given the commercial history of this site can anyone explain why the Applicant was allowed to submit applications in 2001, 2005 and 2010 each one lacking the statutory requirement of a statement on potential contamination?

Anyone applying for planning permission on the Council's planning portal can see that a statement on contamination is an elementary, Stage 1, application requirement; especially if you are the owner of a former filling station (1920s-1992) which still has petrol tanks beneath its forecourt; your site is still to this day in use as a car service and repair workshop; your garage roof is made of degraded asbestos concrete (circa 1950s).

Can anyone explain to me how and why Wandsworth Council could waive such a requirement for three separate applications for the same development site?

Can anyone explain to me why the site was never investigated for contamination despite the Applicant applying to convert it from commercial use into residential use; despite planning legislation which very clearly states that an investigation of potential contamination is required in order to protect those people most at risk in a commercial-to-residential conversion like this, ie. pregnant women and children (PPS23 Annex 2)? 

Can anyone explain to me why the planning permissions in 2001 and 2005 contained no Management Plan or Planning Conditions for remediation or cleaning up of the site BEFORE the construction of the residential flats could begin?

My application to the Council's Freedom of Information Officer under the Environment Information Regulations showed that the issue of contamination had never been the subject of any recorded internal communication what so ever, so how can it be the case that Wandsworth Council 'assumed' no potential for contamination at a commercial site such as this with such a long history of handling contaminants?

I and a resident barrister had a meeting with Justine Greening MP on the 19th November 2010 specifically to raise this issue.  A great deal of pressure was brought to bear by me and conservation area residents on Wandsworth's Borough Planner (collective term). Eventually the Council's Head of Development Control, clarified by an e-mail from the PAC Chairman Cllr. Cuff confirmed that the Developer would have to investigate the site for potential contamination FIRST, BEFORE he was able to start his development.   Yet by May 2011 the Council had reneged, allowing the Developer to commence his development triggering his planning permission indefinitely.

The site was never assessed for potential contamination.  Instead WBC did all they possibly could to ensure the Developer could go ahead with the minimum required to meet his planning conditions.   It remains that Wandsworth Council have never taken any responsibility for potential contamination of the site.  They washed their hands of the matter and all this despite our MP stating to me, face-to-face that this matter was a "serious worry". 

In planning matters this Council NEVER represents the interests of existing residents.  Consultation is a tick-box exercise for developers pure and simple and a money spinner for consultants, architects and a certain councillor to extract yet more consultancy cash from the planning process.   WBC extend ALL favour and ALL flexibility to Developers, wantonly flouting planning regulations. Whilst our MP sits on the fence appeasing residents, echoing our concerns but doing bugger all to hold the Borough Planner (collective term) to account.

It is a disgrace.
It is criminal.

John, I commend you for your determination.  We need more residents like you to expose what's going on at Town Hall and we desperately need a convincing opposition party and a thorough investigation of planning practices.
