@ David The Conservators are obliged to take further legal advice, as they intended to allow the Covenants by Wandsworth to be broken. The Covenants are in place to protect the common, and Wandsworth agreed to them, but intend to ignore them, as evidenced by the reply from Mr Bright to Nick. The Covenants are legally enforceable and the Conservators are fully aware that WBC intend to breach them. If the Conservators tacitly acquiese to the breaches by not taking legal action the Trustees will be in legal breach of their duties of trust, which will amount to deliberate misconduct by the Trustees. The Trustees resisted getting legal advice for weeks, but realising they were wide open to further criticism for their lack of rigour in governance / personal liability and so on, they caved in. In reply to your point about the "gagging order" it has not been relaxed. I am still "gagged" and not allowed to comment publicly. In view of the fact that I am commenting, the Conservators have retained solicitors to take action against me, so I suspect that my days as a Conservator are now numbered. But that's democracy, Windmill Towers style. |
