The High Court have rejected legal challenges against the imposition of VAT on private schools. The judges admitted that the tax may discriminate against children with special needs for whom there is inadequate provision in the state sector, but refused to exempt  such children from VAT, arguing that it would be unfair on the children with special needs in the state sector.

In my opinion this judgment is deeply flawed. In fact it makes no sense. How can exempting children with special needs in private schools be unfair on children with special needs in the state sector who don’t have to pay the tax? I hope the Appeal Court or the Supreme Court reverses the ruling.

In any case the Government are still in trouble. Parents who have been forced to withdraw their children with special needs from private schools will now sue local authorities to obtain adequate provision in the state sector. A previous court ruling states that in certain circumstances the local authority should also provide taxis. It is going to cost the state a fortune.
