In complex cases it is possible for the court to appoint a lawyer to represent the defendant. The lawyer would then get paid legal aid rates and the process should be more robust. For most magistrate court cases this complexity is not there. For domestic violence cases further rules apply to prevent (for example) the defendant from cross examining the main prosecution witness, almost always his (occasionally her) partner. A lawyer would again be appointed to undertake that role if the defendant is otherwise unrepresented. |
