| Normally when foreigners commit serious crimes, they are imprisoned and then deported upon completion of their sentence. Sometimes by agreement they are allowed to serve the remaining part of the sentence in their country of origin. But the European Convention on Human Rights can be used to block deportation. If the criminal can show that he would persecuted if returned to his homeland or if he has children in this country who would suffer distress, judges might prevent the deportation. That is why it is Conservativesm policy to withdraw from the Convention. |
